D.C. Law 21-185: Commission on Climate Change and Resiliency Establishment Act of 2016

In November 2016 the District of Columbia Council passed legislation to establish a  new Commission on Climate Change and Resiliency to act in 2017. (Act B21-0369 established the first Commission on Climate Change and Resiliency for DC in 2015). The 2016-2017 Commission is responsible for identifying best practices in resiliency, conducting vulnerability assessments for critical infrastructure and systems, and making recommendations for legislative or regulatory changes needed to reduce vulnerabilities, among other duties.

Nevada Executive Order 2019-22 Directing Executive Branch to Advance Nevada's Climate Goals

November 22, 2019

In November 2019, Nevada Governor Steve Sisolak signed Executive Order (EO) 2019-22 directing the executive branch to advance Nevada's climate goals. To accomplish these goals, the governor is requiring state agencies to identify specific policies to reduce in-state greenhouse gas (GHG) emissions and to increase Nevada's resilience to climate impacts. The governor, through the EO, recognized the warming climate in Nevada and the need to take action to mitigate and adapt to other past, present, and future impacts of climate change.

Final Recommendations of the Interagency Ocean Policy Task Force

July 19, 2010

This report is the final set of recommendations from the Interagency Ocean Policy Task Force. The Task Force, a group of 24 senior federal officials led by the Council on Environmental Quality was tasked by President Obama in June 2009 with developing recommendations to enhance the nation's ability to maintain healthy, resilient, and sustainable ocean, coastal, and Great Lake resources for the benefit of present and future generations. One of the National Priority Objectives identified as a premise to the recommendations is to strengthen resiliency of coastal communities and marine and Great Lakes environments, and their abilities to adapt to climate change impacts and ocean acidification.

City of Evanston, Illinois Resolution to Support Environmental Justice

September 2020

The City Council of Evanston, Illinois adopted a resolution that acknowledges the harm that communities of color have experienced due to environmental injustices, and pledges to support environmental justice through initiatives such as creating a public engagement policy, incorporating environmental justice into City ordinances, policies, and processes, and developing a geographic information system (GIS) inventory of environmental justice areas in Evanston. By addressing the disproportionate impact that the climate crisis has on communities of color, the City of Evanston aims to foster a stronger and more climate resilient city.

South Carolina Disaster Relief and Resilience Act

September 29, 2020

In September 2020, the South Carolina legislature passed the Disaster Relief and Resilience Act ("the act," S. B. 259, codified at S. C. Code Ann. §§ 48-62-10, 48-62-310, 6-29-510(D)) to increase the state's resilience to natural disaster and flooding events. The act establishes the position of Chief Resilience Officer and the South Carolina Office of Resilience to coordinate disaster recovery and resilience efforts within the state, creates the Disaster Relief and Resilience Reserve Fund to finance disaster recovery efforts and hazard mitigation projects, and creates the Resilience Revolving Fund to provide low-interest loans to local governments to perform floodplain buyouts and restoration.

Vermont Global Warming Solutions Act

In September 2020, the Vermont State Legislature passed the Vermont Global Warming Solutions Act (H.688), which requires the state to pursue climate solutions that reduce greenhouse gas (GHG) emissions and support environmental and economic resilience. Specifically, the act transforms Vermont's existing GHG emission reduction goals into legal requirements and orders the development of the state’s first Climate Action Plan to identify strategies to reduce state GHG emissions, build healthy and resilient communities, and adapt to Vermont's already-changing climate. Notably, the act includes a provision that allows private citizens to bring a lawsuit against the state government upon the state's failure to adopt or update any rules necessary to implement the Climate Action Plan, including for failure to promulgate rules necessary to implement adaptation or resilience actions, in order to require the state to comply with the act. The act also has a noteworthy focus on equity and ensuring that resilience building programs are accessible to rural, low-income, and marginalized communities.

New York Community Risk and Resiliency Act Implementation Guidance

In November 2020, the New York Department of Environmental Conservation (DEC) released a series of four guidance documents to implement part of the New York Community Risk and Resiliency Act (CRRA), as amended by the New York State Climate Leadership and Community Protection Act (CLCPA). The CRRA requires that state agencies consider future climate impacts as a part of certain planning, permitting, and funding actions. The CRRA also requires that the DEC issue guidance for state agencies and other audiences to implement the CRRA. In accordance with that requirement, DEC issued four guidance documents: (1) Using Natural Measures to Reduce the Risk of Flooding and Erosion, which describes natural resilience measures and their uses for reducing risks associated with erosion and flooding; (2) New York State Flood Risk Management Guidance, which presents recommendations to state agencies on considering flood risk in planning and project implementation; (3) a guide on Estimating Guideline Elevations, which presents the principles introduced in the New York State Flood Risk Management Guidance to assist planners, engineers, designers, and architects in flood mitigation project design; and (4) Guidance for Smart Growth Public Infrastructure Assessment, which provides general principles of climate risk mitigation that state agencies should follow when undertaking "smart growth assessments" required by the CRRA and other state statutes. While these guidance documents were developed by DEC to facilitate implementation of the New York Community Risk and Resiliency Act, much of the information presented is applicable to other jurisdictions that seek to manage floodplains in accordance with climate risks.

California Executive Order N-82-20 Addressing the Biodiversity Crisis

October 7, 2020

California Governor Gavin Newsom signed an Executive Order on October 7, 2020 creating a California Biodiversity Collaborative and setting a goal of conserving at least 30% of the state’s land and coastal waters by 2030 to combat the biodiversity and climate crises. The EO also calls for engaging with stakeholders across California to, among other things: prioritize investments to protect biodiversity, habitat restoration, wildfire resistant and sustainable landscapes; protect pollinators, native plants and animals, and soils; naturally sequester carbon; and develop a “Natural and Working Lands Climate Smart Strategy.

California SB 379: Land use; general plan; safety element; climate adaptation

October 8, 2015

California SB 379 requires all cities and counties to include climate adaptation and resiliency strategies in the Safety Elements of their General Plans upon the next revision beginning January 1, 2017. The bill requires the climate adaptation update to include a set of goals, policies, and objectives for their communities based on the vulnerability assessment, as well as implementation measures, including the conservation and implementation of natural infrastructure that may be used in adaptation projects.

Hawaii Ocean Resources Management Plan

July 2013

The Hawaii Ocean Resources Management Plan (ORMP) is a statewide plan that presents the State’s ocean and coastal resource management priorities, and provides guidance to state agencies with responsibilities relating to marine and coastal zone management. The ORMP was updated in July of 2013, and again in 2020, and was developed under the Hawaii State Office of Planning Coastal Zone Management Program with the participation of county, state and federal agencies responsible for ocean and coastal resources, along with input from the community.
