"Stationarity Is Dead" -- Long Live Transformation: Five Principles for Climate Change Adaptation Law

2010

This Article argues for a flexible model of climate change adaptation law to increase the resilience and adaptive capacity of socio-ecological systems. It provides cases of climate change impacts already having a profound impact on these systems, and makes an argument for why environmental laws and policies are not keeping up with the changes afoot.   It lays out five principles and several sub-principles for environmental regulation and natural resource management, to guide climate change adaptation law.

Guidelines for Implementation of the California Environmental Quality Act (CEQA)

On December 30, 2009 the California Natural Resources Agency adopted the California Environmental Quality Act (CEQA) Guidelines Amendments. The new CEQA Guidelines require projects subject to CEQA to consider potential environmental effects caused by GHG emissions.

Connecticut Public Act No. 08-98, Substitute House Bill No 5600

June 2, 2008

Public Act No. 08-98, An Act Concerning Global Warming Solutions, took effect on October 1, 2008 and set greenhouse gas emissions reduction goals for the State of Connecticut. Section 7 of this Act calls for the Governor's Steering Committee on Climate Change to create a sub-committee to (1) assess the impacts of climate change on state and local infrastructure, public health, and natural resources and habitats; (2) develop recommendations and plans that would enable state and local government to adapt to such impacts; and (3) provide technical assistance to implement recommendations and plans.

Maryland's Living Shoreline Protection Act of 2008 (HB 973)

April 22, 2008

In its January 2008 interim report, the Maryland Commission on Climate Change recommended that the state begin to actively address the impacts on the natural environment of shore erosion induced by sea level rise. The Commission's report recommends a unified approach to shoreline management. Specifically, the Commission suggests that the state resolve management conflicts presented by the current statute and regulatory practice of permitting shore protection alternatives based on the order of preference.

Colorado Executive Order B007 08

Signed by Governor Ritter in April 2008, Executive Order B007 08 created the state's Climate Change Advisory Panel, and authorized the panel to make recommendations to achieve the goals of Colorado's Climate Action Plan, including mechanisms for adaptation planning. .

Pennsylvania Climate Change Act of 2008

July 9, 2008

The Pennsylvania Climate Change Act of 2008 (Act 70) established a Climate Change Advisory Committee for purposes of advising the PA Department of Environmental Protection (DEP) on implementation of the Act. These activities include, but are not limited to, the designation of a voluntary greenhouse gas registry, the delivery of a greenhouse gas inventory report, the creation of an impacts assessment and the development of a climate change action plan.

Iowa Code 2009, Title 11, Subtitle 4, Section 473 - Energy Development and Conservation

November 4, 2009

Following a report in December 2008 from the Iowa Climate Change Advisory Council, the Iowa Legislature requested additional information on the ramifications of climate change for the state, and enacted a new bill in 2009 (Sec. 27, Section 473.7, Code 2009 amended) requiring a climate change impacts review to be conducted and reported. The resulting report, "Climate Change Impacts on Iowa" was then produced by the Climate Council in 2010.
