Washington HB 1181: Climate Change in Local Comprehensive Planning

In July 2023, the Washington State Legislature enacted HB 1181, requiring many local governments in the state to plan for climate change impacts as part of their comprehensive planning processes. The legislation integrates these new requirements by amending the local planning requirements in the state’s Growth Management Law.

New Jersey Inland Flood Protection Rule
July 1st 2023
The New Jersey Department of Environmental Protection adopted a new rule created to better respond to increased flooding due to climate change. The new Inland Flood Protection rule updates rainfall data, which was previously calculated only through 1999, and accounts for future climate conditions in design requirements for new and reconstructed investments in high-risk areas. The new rule, initially proposed by DEP in December 2022, was filed in June 2023 and effective July 2023. The impetus for changing the rule was in response to the effects of Tropical Storm Ida in 2021.

Oregon HB 3409 (2023): Establishing New Resilience Planning and Procedural Measures
June 24, 2023
In 2023, Oregon’s legislature passed House Bill 3409, which created new requirements and programs designed to reduce greenhouse gas emissions and build resilience to the impacts of climate change. In addition to specifying new building energy efficiency and performance standards, the Bill establishes procedures and plans for climate adaptation measures, such as sources of funding, regulatory directives, and adaptation governance.

Louisiana HB 526: Chief Resilience Officer and Interagency Resilience Coordination Team
June 13, 2023
In 2023, Louisiana House Bill 526 was adopted and signed into law as Act 315, establishing the position of Chief Resilience Officer within the Office of the Governor by statute, and mandating a cross-government approach to resilience and environmental hazards faced by the state.

Ready-to-Fund Resilience Toolkit
March 2022
The “Ready-to-Fund Resilience” toolkit, published in March 2022, is designed to help local government staff and their technical assistance providers better understand and prepare to receive funding and financing opportunities for climate resilience, and to create equity through these opportunities as well. The toolkit is a self-guided resource intended specifically for small- and-mid-sized local government practitioners working on resilience or department leads with power over, and a stake in, climate resilience funding and finance, and organizations and government bodies with the capacity and jurisdiction to support local government climate resilience funding and finance through policy, resources, technical assistance, partnerships, or process change.

Frederick County, Maryland: Floodplain District Standards

In order to protect public health, reduce property damage, and protect water supply, Frederick County established a floodplain district and codified restrictions on development activity within that district. Section 1-19-9.110 of the Frederick County Code of Ordinances most notably details both enhanced setback standards and freeboard standards.

Montana HB883 (2023): Funding for Fire Suppression and Preparedness Efforts

On May 22, 2023, the Montana State Legislature passed House Bill 883. HB 883 amended Montana Code § 76-13-150 (2023), adding a one-time grant of $152 million to the fire suppression account in the state special revenue fund and expanding fund usage to include fire preparedness.

Woodbury, New Jersey: Ordinance No. 2386.23 - Freeboard Regulations
May 15, 2023
In a bid to promote public health and safety while also limiting flood-related losses, the City of Woodbury, New Jersey, passed Ordinance no. 2386.23, which introduces regulations for development in flood hazard areas. Most notably, the ordinance establishes additional freeboard for critical facilities, and directly points to the authority of the American Society of Civil Engineers in its standard for Flood Resistant Design and Construction (ASCE 24) as the explanation for doing so.
