S.3510 - Disaster Resiliency Planning Act
Signed into law by President Biden in December of 2022, the Disaster Resiliency Planning Act (Public Law No. 117-221) requires the Office of Management and Budget to develop guidance “requiring the head of each agency to incorporate natural disaster resilience into real property asset management and investment decisions made by the agency.” The legislation was authored by U.S. Senator Gary Peters (D-MI), Chairman of the Homeland Security and Governmental Affairs Committee, and U.S. Senator Rick Scott (R-FL). The Act builds off a 2021 Government Accountability Office report on federal real property management and disaster resilience. The report emphasized the billions of dollars appropriated to agencies for repairing federal property damage from natural disasters and recommended enhancing the resilience of federal property to disasters through asset management.
In compliance with the Disaster Resiliency Planning Act, on November 29, 2023 the Office of Management and Budget released Advancing Climate Resilience through Climate-Smart Infrastructure Investments and Implementation Guidance for the Disaster Resiliency Planning Act.
