State of California Executive Order N-19-19

California Governor Gavin Newsom signed Executive Order N-19-19 on September 20, 2019 to require the redoubling of the state’s “efforts to reduce greenhouse gas emissions and mitigate the impacts of climate change while building a sustainable, inclusive economy.” The Executive Order (EO) includes four main directives:

Connecticut Executive Order No. 3 - Governor's Council on Climate Change, adaptation planning
September 3, 2019
On September 3, 2019, Connecticut Governor Ned Lamont signed Executive Order (EO) No. 3 that includes climate change mitigation and adaptation provisions. The existing Governor's Council on Climate Change will expand its responsibilities to both implement Connecticut’s 2013 adaptation plan, and prepare an updated plan by 2021. The updated adaptation plan will include recommendations for helping vulnerable communities, and for supporting regional and municipal adaptation efforts. Additionally, the Council is directed to establish a framework for state agencies to compile and maintain an inventory of vulnerable assets to inform future vulnerability assessments.

Wisconsin Executive Order No. 38: Creation of the Office of Sustainability and Clean Energy
August 16, 2019
On August 16, 2019, Wisconsin Governor Tony Evers signed Executive Order (EO) No. 38 to create the Office of Sustainability and Clean Energy at the Wisconsin Department of Administration (DOA), whose main task is developing a Clean Energy Plan to assist the state in adapting to and mitigating the harm from climate change by using clean energy resources and technology.

New Hampshire Senate Bill (S.B.) 285: Establishing a Coastal Resilience and Economic Development Program
August 3, 2019
On August 3, 2019, the State of New Hampshire passed Senate Bill (S. B. ) 285 to establish a coastal resilience and economic development program and provide local governments with innovative new tools to address climate emergencies due to sea-level rise, storm surge, and flooding. One notable provision of the bill allows municipalities to either alter their existing boundaries or create a new municipality by combining existing ones (Section 2, codified in New Hampshire Revised Statutes § 31:9-d).

New York State Climate Leadership and Community Protection Act (SB S6599)
July 18, 2019
Passed in July of 2019, New York State’s Climate Leadership and Community Protection Act (CLCPA) (Senate Bill S6599) commits the State of New York to implementing several integrated climate adaptation planning and climate justice goals. In addition to aggressive climate mitigation goals — including zero GHG emissions by 2050 and 100% renewable electricity usage by 2040 — the Act aims to address adaptation and resilience across state programming, land use planning, and local government support.

State of Montana Executive Order 8-2019: Creating the Montana Climate Solutions Council and Joining the State of Montana to the U.S. Climate Alliance
July 1, 2019
On July 1, 2019, Montana Governor Steve Bullock signed Executive Order 8-2019, establishing the Montana Climate Solutions Council and committing the state to the U. S. Climate Alliance. The Executive Order directs the Council to work with state agencies to incorporate climate adaptation and resilience strategies into state plans and operations, and to put forth recommendations for reducing Montana’s contributions to greenhouse gas emissions. Notably, the EO requires that future state planning efforts include adaptation strategies and considerations for better preparing the state for climate-related risks and disasters, and that, where necessary, agencies prepare a Supplemental Climate Plan on adaptation and resilience for current and future state plans.

An Act to Promote Clean Energy Jobs and to Establish the Maine Climate Council
June 26, 2019
In June 2019, Maine Governor Janet Mills signed into law "An Act to Promote Clean Energy Jobs and to Establish the Maine Climate Council. " The act states that the impacts of climate change have created an "emergency within the meaning of the Constitution of Maine" and find that the law is "immediately necessary for the preservation of the public peace, health and safety. " To address the state's climate emergency, the act includes multiple provisions related to climate adaptation and resilience.

Santa Monica Sustainability Rights Ordinance
June 25, 2019
The Santa Monica Sustainability Rights Ordinance, adopted by the Santa Monica City Council in June 2019, declares a human right to a healthy environment and grants natural ecosystems a right of existence. The ordinance reaffirms the City’s commitment to protecting and modeling sustainability, including with regard to rights it recognizes but believes existing law fails to protect. The ordinance empowers citizens to bring suit to protect nature’s rights and their own related to the environment.

Norfolk Special Service District Policy for Flood Protection

In June 2019, the Norfolk City Council adopted a policy authorizing the creation of Special Service Districts (SSD) to support implementation of local flood risk reduction and water quality improvement projects in the City of Norfolk, Virginia. SSDs enable a group of residents to agree to pay a tax to finance additional services in a particular neighborhood. The Norfolk policy allows SSD funding to be used to pay for flood mitigation, dredging, water quality improvements, and coastal protection projects.

New York Model Local Laws to Increase Resilience (Chapter 1: Basic Land Use Tools for Resiliency)
June 2019
In June 2019, the New York Department of State published model local laws to increase resilience as part of its required actions under the State’s Community Risk and Resiliency Act (CCRA). The model laws are divided into chapters addressing land use and zoning, wetlands and watercourses, coastline protection, floodplain management, and stormwater control. The first chapter addresses zoning and land use as resiliency tools, outlines how to use zoning policies to accomplish resiliency goals, and includes model language local governments can adapt to that purpose.
