Virginia S 265: Special Assistant to the Governor for Coastal Adaptation and Protection

On June 22, 2018, Virginia Governor Ralph Northam signed Senate Bill 265 creating a new cabinet-level position to address coastal adaptation and protection in Virginia. The bill states that the Special Assistant to the governor will be responsible for leading statewide efforts in response to coastal flooding; working to initiate economic development opportunities associated with adaptation; and fostering coordination throughout the Commonwealth, especially in Hampton Roads, a coastal region of the state that is most vulnerable to sea level rise and land subsidence.

Connecticut Executive Order No. 66: State Water Plan (and State Water supply as Public Trust)

Connecticut Governor Malloy’s executive order directs the state’s Water Planning Council (WPC) to immediately implement the State Water Plan - that was submitted to the Connecticut General Assembly in January 2018. The EO recommits to the definition of water as a public trust – a declaration of public policy that has been in the state statute for more than 40 years. A Public Trust is essentially a policy that recognizes the public’s inherent right to water, among many other rights.

Connecticut SB 7: An Act Concerning Climate Change Planning and Resiliency (Public Act 18-82)

SB 7 supports both climate change mitigation and adaptation measures for Connecticut, with directives that will help to prepare the state for climate impacts, primarily sea level rise. Connecticut’s statutory references to sea level rise will now reflect the Connecticut Institute for Resilience and Climate Adaptation’s (CIRCA) planning recommendation of nearly two feet by 2050. The legislation requires all state or federally-funded coastal infrastructure projects to take this new sea level rise projection into account when being planned and developed.

California Proposition 68 - Parks, Environment, and Water Bond

Proposition 68 is a $4 billion bond measure to protect California’s water, parks, and natural resources, while bolstering climate adaptation, resilience, and social equity statewide. This proposition allows the state to sell General Obligation bonds for various natural resources-related programs - including $443 million to be allocated for climate adaptation and resiliency projects throughout the state. California Senate Bill 5 (De León), “California Drought, Water, Parks, Climate Coastal Protection, and Outdoor Access for All Act of 2018” put this bond measure on the June 5, 2018 ballot.

Foster City, California Measure P - Sea level rise abatement bond

Measure P is a $90 million bond measure approved by Foster City, San Francisco Bay area of California in June 2018, that will fund structural projects to reduce flood risks from sea level rise. Residential, office and commercial property owners will see an annual tax rate increase of approximately $40 per $100,000 of assessed property value.

California SB 606 - Water Management Planning

California Senate Bill 606 - Water Management planning was enacted with contingency on the passage of Assembly Bill 1668, both addressing water conservation and drought resilience across the state. Both respond to Governor Brown’s 2016 Executive Order B-37-16 - “Making Water Conservation a California Way of Life” which directs permanent changes to use water more wisely, eliminate water waste, strengthen local drought resistance, and improve agricultural water use efficiency and drought planning.

California EO B-52-18 - Executive Order to improve forest and community resilience to wildfire and other climate impacts

California Governor Brown issued Executive Order B-52-18 to support the state’s resilience to wildfire and other climate impacts, address extensive tree mortality, increase forests' capacity for carbon capture, and improve forest and forest fire management. Wildfires of magnitude exacerbated by drought and other climate factors are impeding the state’s efforts to mitigate GHGs - while bringing catastrophic effects onto communities, wildlife, and watershed health. The Order commits $96 million in additional state funds to: Improving Forest Management and Restoration; Providing Regulatory Relief; Reducing Barriers for Prescribed Fire; Boosting Education and Outreach to Land Owners; and for Supporting Wood Products Innovation.

Maryland HB 1350/ SB 1006 - Sea Level Rise Inundation and Coastal Flooding - Construction, Adaptation, and Mitigation
April 5, 2018
Effective July 1, 2018, Maryland will expand and strengthen its "Coast Smart" siting and design criteria to better manage sea level rise and improve coastal adaptation efforts. The legislation also requires the state to establish a plan to adapt to saltwater intrusion, and to build criteria for hazard mitigation funding for sea level rise and coastal flooding. Additionally, by July 1, 2019, local jurisdictions that experience nuisance flooding must submit a plan to address this climate impact.
