New York City Climate Resiliency Design Guidelines

In April 2018, New York City released new Climate Resiliency Design Guidelines that apply to all City capital projects, aside from coastal protection projects. The guidelines direct planners, engineers, architects, and others involved in project delivery on how to use regionally-specific future climate projections in the design of City facilities.

Safer and Stronger Cities: Strategies for Advocating for Federal Resilience Policy

In March 2018, the 100 Resilient Cities (100RC) initiative released the "Safer and Stronger Cities" report with a series of policy recommendations on how the federal government could help support urban resilience initiatives. Five chapters focus on strategies for enhancing resilience through infrastructure, housing, economic development, and public safety. Each chapter provides a background discussion of the resilience challenges for cities; the opportunities to enhance resilience in these focal areas including climate adaptation strategies; and case study examples of local, state, and federal actions to advance resilience in each sector.

Climate Adaptation and Liability: A Legal Primer and Workshop Summary Report

The Conservation Law Foundation addresses the legal liability risks of decision makers if they fail to prepare for climate change impacts to infrastructure in this report. Theories of legal liability are described for design professionals (such as engineers and architects) or government entities (like a city or a water reclamation district) as related to climate adaptation and resilience of buildings, roads, and other critical infrastructure. The report was produced from workshops that took place in Boston and has many references to specific laws and regulations in Massachusetts.

Building a Better Norfolk: A Zoning Ordinance of the 21st Century - Norfolk, Virginia
January 23, 2018
The City of Norfolk, Virginia adopted a new zoning ordinance in 2018 to enhance flood resilience and direct new more intense development to higher ground. The ordinance establishes a Coastal Resilience Overlay (CRO) zone, where new development and redevelopment will have to comply with new flood resilience requirements, and an Upland Resilience Overlay (URO), designed to encourage new development in areas of the city with lower risk of flooding.

New York Tidal Wetlands Guidance Document

From the New York State Department of Environmental Conservation (DEC), this document offers guidance on permitting requirements for public or private living shorelines projects in the Marine and Coastal District Waters of New York (Lower Hudson River to the tip of Long Island). Intended for permitting staff, design professionals, and property owners, this guidance encourages living shorelines over other hardening approaches for flood and erosion control and promotes consistent permit determination for living shoreline projects.

Rhode Island Coastal Setbacks and Coastal Buffer Zones

Rhode Island, under the Coastal Resources Management Council (CRMC), mandates erosion-oriented setbacks and Coastal Buffer Zones (Rhode Island Administrative Code 650 20-00-1. 1, Adopted November 2017). The Rhode Island CRMC is the state’s regulatory coastal management agency. These regulations better protect structures and conserve important coastal ecosystems by determining setbacks and buffers based on accelerating rates of sea-level rise and erosion. Setbacks are based on average annual rates of erosion as measured on localized, property-scale maps.

Alaska Order 289: Climate Change Strategy, Climate Action Leadership Team

California SB 667 - Department of Water Resources: riverine and riparian stewardship improvements

SB 667 updates the California Water Code requiring the California Department of Water Resources (DWR) to establish a program to implement watershed-based riverine and riparian stewardship improvements through technical and financial assistance. The program will support projects that “reduce flood risk, restore and enhance fish populations and habitat, improve water quality, achieve climate change benefits, and in general ensure resilient ecological function within areas that include, but are not limited to, urban or urbanizing areas of the state.

Rhode Island H 5042/S 1005 2017: Flooding and Sea Level Rise Training for Municipal Planning Boards and Commissions

Rhode Island has approved legislation that requires all members of local planning boards and commissions to participate in a training program on the impacts of flooding and sea level rise to the state. One of the priorities is to help ensure that local decision makers can calculate the effects of sea level rise and flooding on development and land use in flood plains. The training is a free two-hour course required once every two years, for both coastal and inland municipalities - as flooding is expected on inland rivers and waterways as sea level rises as well.
