S.3510 - Disaster Resiliency Planning Act

December 5, 2022

Signed into law by President Biden in December of 2022, the Disaster Resiliency Planning Act (Public Law No. 117-221) requires the Office of Management and Budget to develop guidance “requiring the head of each agency to incorporate natural disaster resilience into real property asset management and investment decisions made by the agency. ” The legislation was authored by U. S. Senator Gary Peters (D-MI), Chairman of the Homeland Security and Governmental Affairs Committee, and U. S. Senator Rick Scott (R-FL).

Louisiana Adaptive Governance Initiative

November 2022

Following the directives issued in Executive Order JBE 2019-19, which aimed to improve the state’s resilience in the face of changing environmental conditions, Louisiana’s Adaptive Governance Initiative (AGI) was developed to build government capacity and identify ways in which coastal changes will impact the work and responsibilities of various state agencies. The AGI developed various tools to assist agencies in identifying ways in which coastal change will impact their specific resources and responsibilities, and address how they might adapt to those vulnerabilities.

South San Francisco Zoning Code - Flood Plain / Sea-Level Rise Overlay

October 2022

In October 2022, the South San Francisco, CA City Council, updated its zoning code to incorporate a Flood Plain/Sea Level Rise (SLR) overlay district intended to “mitigate the impacts of sea level rise, and protect the health, safety, and welfare of residents of [South San Francisco]. ” The additional purposes of the overlay district are to “limit the potential impact of coastal flooding and erosion patterns on coastal development,” adapt to climate change, create adaptation strategies with a priority on long-term resilience, “establish standards consistent with the San Mateo County Flood and Sea Level Rise Resiliency District,” introduce “flood-proof” construction to South San Francisco, and restore creek ecologies to build resilience.

Maryland Senate Bill 630 (2022): Maryland Department of Emergency Management - Office of Resilience

October 1, 2022

On October 1, 2022, Maryland Senate Bill 630 took effect, establishing the Maryland Office of Resilience within the Department of Emergency Management and creating a Chief Resilience Officer (CRO) to coordinate resilience efforts across state government. The Bill, which is codified in the state’s Public Safety Code in a new Subtitle 12, requires the Office of Resilience, led by the CRO, to coordinate across state agencies and local governments to “build resilience to risks identified in the Maryland Hazard Mitigation Plan.

Montgomery County Council Bill 3-22

July 2022

On July 12, 2022, the Montgomery County Council passed Council Bill 3-22, requiring climate assessments for future legislation. The aim is to provide decisionmakers with information on climate implications (emissions and resilience) of decisions they may make. The legislation responded to the Council’s Resolution 18-974 in 2017, which declared a climate emergency and set emissions goals.
