In June 2019, the New York Department of State completed a set of model local laws to increase resilience as part of its required actions under the State’s Community Risk and Resiliency Act (CCRA). The model laws are meant to inform municipalities who want to adapt their own resiliency measures. Five categories of model laws are included in the model, which is divided into five corresponding chapters. The second chapter addresses wetlands and watercourse protection measures including buffers, overlay districts, and watercourse setbacks.

In June 2019, the New York Department of State published model local laws to increase resilience as part of its required actions under the State’s Community Risk and Resiliency Act (CCRA). The model laws are divided into chapters addressing land use and zoning, wetlands and watercourses, coastline protection, floodplain management, and stormwater control. The fifth chapter addresses stormwater control measures, including reduction of impervious surfaces and mitigation where reduction isn’t available, and includes model language local governments can adapt to that purpose.

The model laws are divided into chapters addressing land use and zoning, wetlands and watercourses, coastline protection, floodplain management, and stormwater control. The fourth chapter addresses floodplain development management, including overlay districts and critical facilities protection, and includes model language local governments can adapt to that purpose.

Maine Act to Help Municipalities Prepare for Sea Level Rise (LD 563)
May 29, 2019
Maine Governor Janet Mills signed into law LD 563, “An Act to Help Municipalities Prepare for Sea Level Rise” in May 2019. The law amends the State’s growth management and local land-use planning requirements (at Title 30-A, Chapter 187 of the Maine Code) to address the effects of sea-level rise. It allows coastal municipalities and “multimunicipal” regions including coastal municipalities to consider sea level rise projections and potential effects on buildings, transportation infrastructure, sewage treatment facilities, and other municipal or private facilities.

Washington State Natural Disaster and Resiliency Activities Work Group
May 13, 2019
On May 13, 2019, Governor Jay Inslee of Washington signed into law Substitute Senate Bill (SSB) 5106. The bill mandates the establishment of a Natural Disaster and Resiliency Activities Work Group, chaired by the Office of the Insurance Commissioner, tasked with reviewing disaster resiliency activities in the state and making recommendations to the legislature and governor on whether an ongoing disaster resiliency program should be created. The Work Group is noteworthy for its focus on coordinating state-level activities related to disaster mitigation in a changing climate and for its emphasis on learning from the activities and coordination efforts of other state, federal, public, and private organizations.

Virginia Beach Public Works Design Standards Manual - Sea Level Rise and Precipitation Adjustments for Stormwater Management Design

In 2019, the City of Virginia Beach updated its Public Works Design Standards Manual (Manual) to account for climate change impacts in drainage system design requirements that help control stormwater runoff. The Manual provides minimum design standards for all City public works projects within City rights-of-way, easements, and City-owned properties (e. g. , roadway, drainage, and traffic signal design standards). Section 8 of the Manual addresses stormwater management, and unlike most of the rest of the Manual, its standards apply to all private projects as well as City construction projects relating to stormwater management.

Prince George's County, Maryland Environmental Justice Commission
April 2019
In 2018, the Maryland General Assembly enacted the Maryland House Bill 183 (HB183) establishing the Environmental Justice Commission to address the environmental and public health concerns in Prince George's County. HB 183 lists the composition of the Commission, outlines the missions and duties of the Commission, mandates a findings and recommendations report along with a plan of action within two years and a month. Enacting the commission to facilitate environmental justice in Prince George's County can help improve inequities of low-income and minority residents in the area impacted by climate change. After the Commission had submitted the first final report in February 2019, the General Assembly further acknowledged the Commission’s work and passed HB 1362 in April 2019 to extend the termination date of the Commission to June 30th, 2020. The final report was submitted on January 10th, 2020.

New Mexico SB 489 - Energy Transition Act

New Mexico’s 2019 Senate Bill 489 enacts the Energy Transition Act, establishing ambitious statewide renewable energy standards and a pathway the state will use to transition its economy towards one powered by clean energy. The bill includes tens of millions of dollars of economic and workforce support for communities affected by the transition away from coal. By incorporating equity considerations into its framework, this bill not only ensures greater renewable energy production, but also eases the burden of energy transition on frontline and disadvantaged communities.
