Resilient Rhode Island Act (2014-H 7904)

June 19, 2014

On June 19, 2014 both houses of the Rhode Island legislature passed the Resilient Rhode Island Act of 2014. The Act follows Governor Chafee’e Executive Order creating the Rhode Island Executive Climate Change Council (February 21, 2014), and provides a framework for state government to adaptively plan for and manage climate change impacts.

Hawaii Climate Adaptation Initiative Act (HB 1714, Act 83)

June 9, 2014

Hawai'i Act 83 establishes an interagency climate adaptation committee to develop a sea-level rise vulnerability and adaptation report addressing statewide climate impacts projected up to 2050. This bill was approved by Governor Neil Abercrombie on June 9, 2014.

From the Environmental and Natural Resources Law Clinic at Widener Law, this report reviews the legal tools available for sea level rise adaptation in the State of Delaware, and analyzes the legal issues related to the use of each tool. The report also discusses the current status of the tools under Delaware law, and provides recommendations for changes needed in Delaware law to make them more effective.

Oxford, Maryland Stormwater Management and Shoreline Protection Fund, Ordinance 1403

May 13, 2014

On May 13, 2014 the town of Oxford, Maryland adopted a pioneering ordinance to create a Stormwater Management and Shoreline Protection (SMSP) Fund. Oxford commissioners unanimously agreed to increase the town’s property tax rate in order to collect fees for the maintenance, enhancement, improvement and repair of the Town’s stormwater management and shoreline protection improvements, facilities and systems. The fund will raise approximately $100,000 per year to help mitigate ongoing and increasing impacts from flooding throughout the community.

Maryland HB 615: Coast Smart Council Law

May 5, 2014

Maryland’s Coast Smart Council bill (House Bill 615) was signed by Governor Martin O’Malley on May 5, 2014; the law directs that all new and reconstructed State facilities be planned and built to avoid or minimize future flood damage. The law also creates the Coast Smart Council to oversee the state infrastructure projects.

Maine LD 1602 – Establishes a Commission to study the impacts of ocean acidification in Maine

April 30, 2014

On April 30, 2014 Maine addressed the threat of ocean acidification with a new law: 'Resolve, Establishing the Commission to Study the Effects of Coastal and Ocean Acidification and Its Existing and Potential Effects on Species That Are Commercially Harvested and Grown along the Maine Coast. ’ The first of its kind on the East Coast, the law considers the impacts of rising carbon dioxide levels in the ocean on the ecosystem and on commercial shellfish grown and harvested along the Maine coast.

One City, Rebuilding Together: A Report on the City of New York's Response to Hurricane Sandy and the Path Forward

This report reviews New York City’s housing recovery efforts after Hurricane Sandy through the “Build It Back” program. The report highlights actions already taken by the City to address existing concerns with the program and makes extensive recommendations for other changes, representing a major overhaul of currently active recovery programs.
